The IRS defines eligible medical expenses as costs paid for the diagnosis, cure, mitigation, treatment, or prevention of disease. Prescription drugs dispensed by a licensed pharmacist meet that definition without further documentation in most cases.
The FDA approved modafinil in 1998 under NDA 020717 for narcolepsy, and subsequently expanded labeling to cover obstructive sleep apnea and shift work sleep disorder. 1 Because these are recognized diagnoses under ICD-10, reimbursement through a health savings account or flexible spending account follows automatically when a prescription exists.
What the IRS Actually Says
IRS Publication 502 states: "You can include in medical expenses amounts you pay for prescribed medicines or drugs." 2 A "prescribed medicine" means one that requires a prescription under federal or state law. Modafinil is Schedule IV under the Controlled Substances Act, so it legally requires a prescription in all 50 states. 3 That makes every dispensed supply of Provigil or generic modafinil automatically eligible.
Off-Label Use and Letters of Medical Necessity
Modafinil is prescribed off-label for conditions including multiple sclerosis-related fatigue and cancer-related fatigue. A 2013 Cochrane review (21 trials, N=1,518) found evidence supporting modafinil for cancer-related fatigue, though effect sizes varied by study design. 4 For off-label uses, most HSA and FSA administrators require a Letter of Medical Necessity (LMN) from your prescribing clinician. The LMN should name the diagnosis, explain why modafinil is medically appropriate, and include the prescriber's NPI number.
Step-by-Step HSA Submission Process
Submitting a Provigil claim to your HSA takes three concrete steps. Pay at the pharmacy, collect documentation, then upload through your administrator's portal. Most administrators process claims within 3 to 5 business days.
Step 1: Pay at the Pharmacy
You can use your HSA debit card directly at the point of sale. Most pharmacy point-of-sale systems recognize HSA-eligible items automatically. If you pay out of pocket instead, keep the receipt, you can reimburse yourself at any time, even years later, as long as the expense occurred after the HSA was established. 5
Step 2: Collect the Right Documentation
Your itemized pharmacy receipt must show:
- Patient name
- Drug name (modafinil or Provigil)
- Prescription number
- Date dispensed
- Amount paid
A credit card statement alone is not sufficient. The IRS and most HSA custodians require the itemized pharmacy printout. 6
Step 3: Submit Through Your Administrator's Portal
Log into your HSA custodian's website (Fidelity, HealthEquity, Optum Bank, HSA Bank, etc.), manage to "Claims" or "Reimbursements," upload the receipt as a PDF or photo, and enter the expense date and amount. Some custodians allow mobile app submission with a camera photo. Processing time is typically 3 to 5 business days; direct deposit to a linked checking account follows within 1 to 2 additional days.
Keep all documentation for at least three years after the tax year in question. An IRS audit can ask you to substantiate HSA withdrawals. 7
FSA Submission: Key Differences from HSA
FSA reimbursement follows the same IRS eligibility rules, but the account mechanics differ in three important ways.
Use-It-or-Lose-It Rules
Unlike HSAs, FSAs do not roll over indefinitely. The IRS allows employers to offer either a grace period of up to 2.5 months past the plan year end (typically March 15) or a carryover of up to $640 (2024 IRS limit, indexed annually). 8 If your Provigil prescription is renewed in December, submitting the claim before December 31 protects those funds.
Dependent Care vs. Healthcare FSA
Only a healthcare FSA (also called a medical FSA or health FSA) covers prescription drugs. A dependent care FSA does not. Confirm with your HR department which account type you hold before submitting.

Ask your pharmacist to dispense the generic, some states require it unless your prescriber writes "dispense as written."

Mechanism of Action
Modafinil's exact mechanism remains incompletely understood, but research points to selective inhibition of dopamine reuptake via the dopamine transporter (DAT), which raises extracellular dopamine in the striatum and prefrontal cortex. 13 Unlike amphetamines, modafinil does not cause significant norepinephrine or serotonin release at therapeutic doses, which may explain its lower abuse potential and Schedule IV rather than Schedule II classification. 14
Clinical Evidence for FDA-Approved Indications
A key randomized controlled trial published in Sleep (N=271) demonstrated that modafinil 200 mg and 400 mg significantly reduced Epworth Sleepiness Scale scores in patients with narcolepsy compared with placebo (P<0.001). 15 For obstructive sleep apnea with residual sleepiness despite CPAP therapy, a double-blind RCT (N=157) showed modafinil 200 mg reduced mean sleep latency on the Maintenance of Wakefulness Test by 1.7 minutes versus placebo (P<0.001). 16
Safety Profile and Scheduling
The Drug Enforcement Administration placed modafinil in Schedule IV because clinical and epidemiological data suggest lower dependence potential than Schedule II stimulants. 17 The FDA label carries a warning for serious dermatologic reactions including Stevens-Johnson syndrome, and for psychiatric symptoms in patients with a history of psychosis, depression, or mania. 18 Prescribers weigh these risks against the functional impairment caused by untreated excessive daytime sleepiness.

For HSA/FSA purposes, the prescription's origin (telehealth vs. In-office) does not affect eligibility. What matters is that a licensed U.S. Prescriber issued a valid prescription and a licensed U.S. Pharmacy dispensed the drug. An itemized receipt from a DEA-registered pharmacy satisfies IRS requirements regardless of how the clinical encounter occurred.
Insurance Coverage and Prior Authorization
Most commercial health plans cover generic modafinil for FDA-approved indications, but require prior authorization (PA). The PA process typically asks for:
- ICD-10 diagnosis code (G47.419 for narcolepsy without cataplexy; G47.33 for obstructive sleep apnea; G47.26 for shift work sleep disorder)
- Documentation of sleep study results (polysomnography) for OSA
- Evidence of CPAP adherence for OSA-related prescriptions
- Failure or contraindication of first-line therapy in some plans
If your insurer denies the PA, you have the right to appeal. For HSA/FSA purposes, armodafinil is equally eligible. Both drugs require a prescription, both are FDA-approved, and both appear on the IRS Publication 502 definition of "prescribed medicines." 24 If your prescriber switches you from Provigil to Nuvigil mid-year, the new prescription is immediately reimbursable through your existing HSA or FSA.

FSA contributions also reduce taxable income, but the account does not grow. For a taxpayer in the 22% federal bracket paying $60/month for generic modafinil ($720/year), routing that expense through an FSA saves approximately $158 in federal income tax plus applicable state and FICA taxes.
